Terms and Conditions

These terms and conditions ("Terms") set out the various rules and procedures that apply when You access and use the Platform, create and maintain an Account with Us, Top Up with Credit, purchase Products, enter a Draw and/or partake in Promotions and/or Competitions. The Rules of Millionaire ("Rules") attached under Annex 1, set out the various rules and procedures that apply when You Enter the Draw and are incorporated into and form part of these Terms.

By accessing and using the Platform, creating, and maintaining an Account with Us, Topping Up with Credit, purchasing Products, Entering a Draw and/or partaking in Promotions and/or Competitions, You agree to be bound by these Terms including the Rules and Additional Policies, all of which are solely and exclusively governed by the laws in force in Iraq. We have also issued the Additional Policies and We recommend that You read and understand each of these before using and accessing the Platform, creating an Account, Topping Up with Credit, purchasing Products, entering a Draw and/or partaking in Promotions and/or Competitions. Copies of the Additional Policies can be found on the Online Services.

These Terms and Additional Policies constitute the entire agreement ("Agreement") between You and Us in relation to You accessing and using the Platform, creating an Account, Topping Up with Credit, purchasing Products, entering a Draw and/or partaking in Promotions and/or Competitions. The Additional Policies are hereby incorporated into and form part of these Terms and by accepting these Terms, you agree to be legally bound by the Terms and Additional Policies.

Definitions and Interpretation

In these Terms, all capitalised words and expressions shall have the following meanings:

Term	Definition
Account	An on-line account maintained by a Participant on the Central Computer System which contains a Participant’s personal information and all other relevant details necessary to enable the Participant to Top Up with Credit, purchase Products, enter a Draw, and withdraw Prizes.
Additional Policies	The Privacy Policy, the Cookies Policy, Social Media Guidelines, FAQs, and any other policy that may be added from time to time.
IQD	Iraqi Dinar, the lawful currency of the Republic of Iraq.
App	The Millionaire mobile application which is distributed through the Apple App Store and Google Play Store.
Authorised Financial Institution	Any banking organization or financial institution authorized by the Manager to pay certain Prizes.
Ball Sets	A set of fourty (40) 50mm (8.5-9.0g) balls made of rubber & foam composite materials and numbered from one ( 1 ) to fourty (40).
Central Computer System	The computer systems used by the Manager from time to time, amongst others, manage Millionaire, administer Accounts, facilitate the Topping Up of Credit, purchase of Products, enable the Entry into a Draw, generate Raffle IDs and pay Prizes.
Competition Prize	As defined in Clause 10.4(b).
Competitions	As defined in Clause 10.1.
Content	Any and all text, images, audio, video, scripts, code, software, databases, and any other form of information capable of being stored on a computer that appears on, or forms part of, the Platform.
Cookies Policy	The Millionaire Cookies Policy, a copy of which can be located on the electronic services.
Credit	Credit is added via a debit or pre-paid card, Ewallet, cash, through Winnings or Competition and/or Promotional Prizes and, where applicable, is located in the "Available Balance" section of Your Account. Credit is used (and can only be used) to purchase Products.
Available Balance	A section in each Participant’s Account which shows Credit.
Customer Support	Millionaire customer support, which can be contacted toll free from within Iraq on 800 40000 from 09:00 am to 10:00 pm (Iraq time), 6 days a week from Saturday to Thursday or by emailing support@millionaire.iq .
Draw	The Draw held on Saturdays, and the process which results in the random selection of the Grand Draw and Raffle.
Draw Machine	A machine that mechanically mixes the Ball Sets and randomly selects the Draw Winning Numbers from that mix.
Entry	A transaction by which a Participant’s entry into a Draw has been recorded as an Entry on the Central Computer System. Enter, Enters, Entered and Entering shall have correlative meanings.
Favourites	A facility whereby a Participant may save their favourite numbers for Entering a Grand Draw.
Grand Draw	The Grand Draw held on Saturdays, and the process which results in the random selection of the Grand Draw Winning Numbers using the Draw Machine.
Grid	A number panel through which 4 numbers are selected from a total of 40 numbers (from 1 to 40) - (either manually, using preferred numbers, or through the quick/random selection feature) to enter the Grand Draw.
Grand Draw Winning Numbers	The four ( 4 ) numbers between one ( 1 ) and fourty ( 40 ) (inclusive) that have been randomly selected for each Grand Draw by the Grand Draw Machine and which are used to determine the Prizes for that Grand Draw.
In-Store Services	A facility whereby a Participant can Top Up Credit at participating retail outlets.
Set	The four ( 4 ) numbers between one ( 1 ) and fourty ( 40 ) (inclusive) that have been chosen by You (whether manually, by Favourites or Quick Pick) for entry into a Grand Draw.
Millionaire	The Grand Draw and the Raffle, managed by Bahidh Al Khair in Iraq and any other Draw or Competitions that may be added from time to time.
Manager, We or Us	Bahidh Al Khair, a limited liability company incorporated in Baghdad acting in its role as the appointed operator of Millionaire.
Minimum Withdrawal Amount	Whilst Your account is active, the minimum amount of Prizes that can be withdrawn is IQD 5,000 (Iraqi Dinar five thousand only).
Online Services	The App and Website.
Participant, You or Your	A member of the public of Iraq who intends to or Tops Up Credit, purchases Products and/or Enters a Draw.
Password	The alphanumeric and special character identifier used by a Participant to identify themselves when accessing their Account. The password policy is: customer can select between 8 and 30 characters (including special characters), with a minimum of one number
Payment Wallet	An eWallet Account from Zain Cash or Fast Pay.
Platform	The Online Services and In-Store Services.
Privacy Policy	The Millionaire Privacy Policy, a copy of which can be located on the Online Services.
Prize	A cash prize won by an eligible Participant in a Raffle Draw and/or one of the prize categories in a Grand Draws specified in the Rules.
Product	A product (in whatever form) available to purchase via the Online Services or Retail Stores using the Available Balance in the Customer's Account. The product would be available for collection at locations designated by Millionaire Company. For every Purchased Product, You will be eligible to submit one ( 1 ) Set and subsequently will receive one ( 1 ) entry to the Grand Draw, and an entry to the Raffle Draw.
Promotion/Competition Terms	As defined in Clause 10.1.
Promotions	As defined in Clause 10.1.
Quick Pick	A feature whereby a set of four ( 4 ) numbers for the Grand Draw are selected for a Participant on a random basis by the Central Computer System.
Raffle Draw	The process which results in the random selection of the Winning Raffle IDs using a Random Number Generator.
Raffle ID	A unique identification number that is automatically generated by the Central Computer System and assigned to each entry and which constitutes one ( 1 ) entry into the Raffle Draw.
Random Number Generator	A computer software system using a random number generator that randomly selects the Winning Raffle IDs from all Raffle IDs entered for the relevant Raffle Draw.
Rules	The Rules for Millionaire, a copy of which can be located under Annex 1 to these Terms or on the Online Services.
Syndicate	A group of participants who Top Up Credit, purchase a Product and Enter a Draw together and share any Prize in proportion to the contribution of each group member.
Terms	These Millionaire Terms and Conditions including the Rules and the Additional Policies.
IQ	Republic of Iraq.
Website	Millionaire’s website www.millionaire.iq (or such other address as may be advised from time to time).
Winning Raffle IDs	The Raffle IDs that have been randomly selected for each Raffle Draw by the Random Number Generator and which are used to determine the Prizes for that Raffle Draw.

Unless the context otherwise requires, words in the singular shall include the plural and, in the plural, shall include the singular.
Any words following the terms "including", "include", "in particular", "for example" or any similar expression shall be construed as illustrative and shall not limit the sense of the words, description, definition, phrase or term preceding those terms.
In the event of any conflict or inconsistency between the various documents set out above, the order of precedence is: ( 1 ) these Terms; ( 2 ) the Privacy Policy; and ( 3 ) the Cookies Policy.
In the event of any conflict or inconsistency between the English and Arabic translations of these Terms, the English version of these Terms shall prevail to the extent of the inconsistency.
If there is any inconsistency between the instructions on the Online Services, or those given by a retail assistant with respect to In-Store Services, Promotion/Competition Terms or promotional and point of sale materials and/or advice and these Terms, these Terms prevail to the extent of the inconsistency.

Information About Us
1. The Online Services are operated by Us. And In-Store Services are operated by a Third Party.
2. You may contact Us by telephoning Customer Support toll-free from within Iraq on 800 40000 from 09:00 am to 10:00 pm (Iraq time), 6 days a week from Saturday to Thursday or by emailing support@millionaire.iq.
Account Registration
1. Eligibility
  1. Certain parts of the Platform (including the ability to Top Up Credit, purchase Products and/or Enter a Draw) require an Account in order to access them.
  2. To be eligible to create and maintain an Account, You must:
    1. be at least 18 years of age.
    2. have an active Iraqi mobile number.
    3. not be prohibited or restricted from accessing the Platform, creating or accessing Your Account and/or Entering a Draw under the laws of the jurisdiction in which You are located when transacting with Us.
    4. not already have an Account.
    5. at all times abide by these Terms and the Additional Policies; or
    6. not appear on a global list of high-risk and sanctioned individuals.
  3. Prior to creating Your Account, you will be required to accept the Terms and Additional Policies. If You do not agree to all of these requirements, you should not use the Platform. Continuing to create an Account, Top Up Credit, purchase Products or Enter a Draw will constitute your acceptance of these Terms and Additional Policies.
  4. We reserve the right to refuse an application to open an Account for any reason and have the right (either internally or by passing such information on to an authorized third party) to verify Your age, identity, and eligibility at any time – We will terminate the Account of any Participant found not to be eligible. In addition, we will only pay Prizes within Iraq and reserve the right to refuse to pay a Participant a Prize if the Participant does not meet the abovementioned criteria. If a Prize is paid to anyone who does not meet the criteria set out in this Clause 3.1, that person will be required to repay the Prize immediately upon Our request.
  5. We make no representations or warranties, implicit or explicit, as to Your legal right to create an Account, Top Up Credit, purchase Products, access or Enter a Draw and/or partake in Promotions and/or Competitions and no person affiliated or claiming affiliation with the Manager shall have authority to make any such representations or warranties. We do not intend for any Draw to be Entered by persons present in jurisdictions in which participation may be prohibited or restricted.
  6. The ability to create an Account, Top Up Credit, purchase Products and the availability to Enter a Draw and/or partake in Promotions and/or Competitions does not constitute an enticement, offer, solicitation or invitation by Us for any persons to create an Account, Top Up Credit, purchase Products, to Enter a Draw and/or partake in Promotions and/or Competitions in any jurisdiction in which such activities are prohibited or restricted.
2. How to Register
  1. In order to open an Account, you will be required to provide Us with certain information about You. You agree to ensure that such information is true, accurate, up to date and is kept complete on an ongoing basis. Updates to Your information may only be made by You through Your Account unless We decide otherwise in Our discretion (and in exceptional circumstances).
  2. We may ask You for further information to verify any aspect of the data You have provided to Us. You agree that We may take reasonable measures to verify the information You have provided.
  3. We process all information provided by You in accordance with the Privacy Policy. By passing information to Us, you agree to Us holding and processing Your information in line with the Privacy Policy.
  4. If you need any help in registering Your Account, please contact Customer Support.
3. Using Your Account
  1. Upon successfully opening an Account, you can Top Up Credit and purchase Products. You must only Top Up Credit, purchase Products and Enter a Draw when You are physically located in a jurisdiction within which it is lawful to do so.
  2. As You are solely responsible for any and all activities conducted through the use of Your Account, you must keep Your Password secure and secret at all times and take steps to prevent it being used without Your permission. In the event that You discover that there has been unauthorized access to Your Account, You should inform Us immediately by contacting Customer Support.
  3. You may not permit another individual to use Your Password and/or Account and You are liable for any harm resulting from disclosing or allowing disclosure of Your Password or from use by any person of Your Password to gain access to Your Account.
  4. You acknowledge that We may investigate any unauthorized access to Your Account.
  5. We are not liable to You for any loss or damage You incur arising out of or in connection with any unauthorized access to Your Account including where the unauthorized access has resulted from Your disclosure of Your Password to third parties, whether by negligence or otherwise.
  6. If You forget Your Password, you can reset it by following the instructions on the Online Services.
  7. Only the individual registered as the holder of the Account is considered the "Participant" and, subject to the Rules in Annex 1, all Prizes will be paid in full only to the registered holder of the Account. We are not responsible or liable for any disputes arising from Syndicates (Groups of Participants).
Purchasing Products Topping Up Credit
1. Products can only be purchased using Credit - please follow the instructions provided on the Online Services or retail stores. You will be able to collect your product from designated locations which are featured on the website. Failure to collect within one Calendar month will result in the collection right being forfeited by the Company. Please ensure that You have checked Your purchase carefully before submitting it. All purchases of Products are final with no cancellation options.
2. To Top Up Your Account with Credit and/or purchase a Product on the Online Services, You must have an Account and a valid debit card or Payment Wallet. To Top Up Your Account with Credit and/or purchase a Product via In-Store Services, you must have an Account and a valid debit or pre-paid card, cash, or other payment method as specified on our website. The Platform or retail assistant (for In-Store Services) will guide You through the purchase process, where You will be able to indicate the amount of Credit and/or Products you wish to purchase. Please ensure that You have checked the amount of Credit or number of Products You are purchasing carefully before submitting it. All purchases of Credit and/or Products are final with no cancellation options. You may not request a refund merely because You have changed Your mind.
3. Credit is denominated in IQD.
4. Where Your Top Up of Credit is successful, the value will be credited and will appear in Your "Available Balance". Once reflected in Your "Available Balance", Your Credit is available for immediate use.
5. No part of the Platform constitutes a contractual offer capable of acceptance. Your order for Credit constitutes a contractual offer that We may, at Our sole discretion, accept. Our acceptance is indicated by Us sending You an order confirmation by in-Account message, email, SMS and/or WhatsApp. Only once We have sent You the confirmation will there be a legally binding Contract between Us and You.
6. There is no general right for a person to Top Up Your Account with Credit and/or purchase Products. We may reject an order for, without limitation, the following reasons:
  1. a. where Our payment providers cannot obtain authorization for Your payment.
  2. b. if Your Top Up of Credit or purchase of Products otherwise breaches these Terms.
  3. c. We suspect that the order has been placed fraudulently or infringes any law or regulation; or
  4. d. We, in our sole discretion, deem it necessary. In the event that We reject a Top Up of Credit and/or purchase of a Product, we will contact You to confirm this and any payment made will be refunded to You as soon as possible. Any refunds due under this Clause 4.7 will be made using the same payment method that You used when Topping Up Credit or purchasing a Product.
Transfer and Withdrawal of Prizes
1. All Prizes will be paid in Iraqi Dinar (IQD) and will be credited and appear in Your "Available Balance" following validation in accordance with Our validation procedures.
2. You can request to withdraw your current Available Balance.
3. You may request withdrawal of your balance at any time.
4. Each request to withdraw funds must be against the total available funds.
5. All withdrawals will be via the exchange house or Ewallets.
6. Withdrawal requests will be subject to any relevant security checks and withdrawal rules in place at the time of processing, including, but not limited to, applicable fees and any additional verification checks.
7. Additional verification checks may include Know Your Client (KYC) verification procedures in accordance with both local and international regulatory standards. Such verification will be mandatory for winnings amounting to IQD 1,000,000.00 or more. Please note that this threshold is subject to adjustments at Our own discretion. Additionally, we reserve the right to require KYC verification for winnings below this amount based on Our own assessment. The initial documents required for this process include, but are not limited to, a copy of Your National ID and/or Passport. Should further documentation be deemed necessary, You will be duly notified.
8. The minimum withdrawal request amount is IQD 5,000. Withdrawal requests between IQD 5,000 and IQD 99,999 are subject to a withdrawal fee. Please refer to Our website for the details on the withdrawal fees. Withdrawals over IQD 99,999 are free of charge. Fees and charges are subject to change and will be applied at the time the withdrawal is requested.
9. Prizes cannot be transferred between Accounts.
10. Please be advised that we are unable to make any payments by cheque, postal order, or similar.
11. We keep all funds in the Wallet in a separate dedicated account, which is independent and is not connected with the Manager’s other operating funds.
Terminating, Varying or Suspending Your Account
1. We may, in Our absolute discretion, terminate, vary or suspend access to Your Account, the Platform, Top Up of Credit, purchase of Products, Entry into a Draw or Your ability to make a withdrawal or transfer from Your Available Balance immediately and without notifying You in advance if:
  1. You register or operate more than one ( 1 ) Account at any one time (in such case We reserve the right to terminate, vary or suspend some or all of those Accounts);
  2. any information that You provide to Us is fraudulent, false, inaccurate, incomplete, or not up to date;
  3. We need to perform essential repair or maintenance work or upgrades on the Platform;
  4. for any reason, we no longer provide Millionaire, or other functionalities such as Accounts or access to the Platform;
  5. We are conducting identity and/or financial verification and security checks; or
  6. We, in our sole discretion, deem it necessary.
2. In the event that We terminate Your Account, you will lose any Credit contained in Your Available Balance. We reserve the right to take one or more of the following actions if you breach these Terms:
  1. terminate, vary, or suspend Your Account, access to the Online Services, the Top Up of Credit or purchase of Products, Entry into a Draw, or the ability to make a withdrawal or transfer from Your Available Balance;
  2. take legal proceedings against You for reimbursement of any and all relevant costs on an indemnity basis resulting from Your breach;
  3. take further legal action against You as appropriate;
  4. disclose such information to law enforcement authorities as required or as We deem reasonably necessary; and/or
  5. any other actions which We deem reasonably appropriate (and lawful).
3. We hereby exclude any and all liability arising out of any actions (including, but not limited to those set out above) that We may take in response to breaches of these Terms.
Time-Out and Self-Exclusion
1. If You wish to limit Your ability to Top Up Credit, purchase Products and/or Enter a Draw for a period of time, it is possible to opt for a short-term time-out or longer-term self-exclusion from Millionaire.
2. If You wish to take a short break from Millionaire, you can choose to apply a time-out exclusion on your Account for a period of between one ( 1 ) week and six (6) weeks.
3. Self-exclusion is a more formal option where you choose to apply a longer self-exclusion period on your Account for any period from six (6) months onwards, including a permanent exclusion.
4. During any time-out or self-exclusion period, you will not be able to Top Up Credit, purchase Products or Enter a Draw, however, you will be able to withdraw Prizes from Your "Available Balance".
5. Once You apply for a time-out or self-exclusion, you cannot change or withdraw Your request.
Closing Your Account
1. If You wish to close Your Account, you may do so at any time by accessing the "My Account" section of the Online Services. Closing Your Account will result in the removal of Your information (including the deletion of any Favourites you have created). Closing Your Account will also remove access to any areas of the Platform that require an Account for access. Note, that your personal data will be stored in accordance with the terms of the Privacy Policy.
2. In order to close Your Millionaire Account, You will need to Withdraw any remaining funds in Your Available Balance.
Promotional Offers and Competitions
1. From time to time, we may make promotional offers ("Promotions") and conduct marketing competitions ("Competitions").
2. Each Promotion or Competition may have its set of specifically defined participation criteria and mechanics, the terms of which will be detailed within the Promotions page on Our website (‘Specific Terms"). The Promotions may also be communicated via advertisements and public relations across all digital and offline mediums. The Promotions will be periodical in nature, of specific duration with fixed start and end dates.
3. Promotions and Competitions are open only to those who meet the eligibility criteria detailed in Rule 2.3. of the Rules and any eligibility requirements detailed in the Specific Terms.
4. Competitions
  1. a. Entries in Promotions or Competitions as part of a Syndicate (Group of Participants) or on behalf of any another person, Syndicate, group, society, or company will not be accepted and joint submissions are not allowed.
  2. If We suspect that an individual has set up a fake email address and/or social media page to circumvent Promotion/Competition Terms, We reserve the right to disqualify all entries that we reasonably believe were generated by that individual.
  3. You accept any Competition or Promotion prize ("Competition or Promotion Prize") We award to You entirely at Your own risk and We are not liable for any adverse consequence You experience because of Your acceptance and/or use of the Competition or Promotion Prize.
  4. All Competition or Promotion Prizes are personal, non-transferable, non-exchangeable and are not redeemable for cash or any other prize.
  5. Where the Competition or Promotion Prize is Credit, the winner must create an Account in order to receive such Competition or Promotion Prize.
  6. We reserve the right (when reasonably required to do so) to replace the stated Competition or Promotion Prizes with prizes that We consider to be of broadly equivalent value. We offer no cash alternative for non-cash Competition or Promotion Prizes and Prize winners must accept prizes in the form offered.
  7. All rights in relation to a Competition or Promotion and Your involvement in it vest exclusively in Us.
  8. If we become aware of any fraud, dishonesty or similar action (or omission) by You which relates to Your entitlement to a Competition or Promotion Prize, We (in Our sole discretion) retain the right to disqualify You and not award You the Competition or Promotion Prize. If the fraud, deceit or similar act is only discovered after the Competition or Promotion Prize has been awarded to You, you must immediately return it (or provide equivalent compensation) to Us after We notify You. We may also deduct any Credit awarded as a Competition or Promotion Prize from Your Available Balance.
  9. We may disqualify You if We, in Our sole discretion, believe that You are in breach of the Promotion/Competition Terms or if You otherwise conduct Yourself in a manner which is inappropriate in the circumstances.
  10. You are disqualified from receiving any Competition or Promotion Prize which, for any reason, you would not be allowed to receive or use by law or where Our award of the Competition or Promotion Prize to You would be unlawful.
  11. We reserve the right, at any time, and from time to time, to modify or discontinue, temporarily or permanently, any Competition or Promotion, including the Promotion/Competition Terms with or without prior notice for any reasons without Us having any liability to You.
  12. If We notify You that You have won a Competition or Promotion Prize by mistake, we may withdraw the notice without providing the Competition or Promotion Prize or having any other liability to you. Where You have mistakenly received Credit as a Competition or Promotion Prize, we may deduct this from Your "Available Balance".
  13. Entries received after the relevant advertised closing date for a Competition or Promotion will not be accepted.
  14. We will notify Competition or Promotion Prize winners within five (5) working days of the end date of each Competition.
  15. Our decision is final and conclusive in all circumstances and no correspondence will be entered into.
  16. We reserve the right to request proof of a Competition or Promotion Prize winner's identity in the form of a passport or national identification document. In the event that a Competition or Promotion Prize winner cannot provide us with proof of identity that is reasonably acceptable to us, we may withdraw the Competition or Promotion Prize and select another Competition or Promotion winner.
5. Promotions
  1. Promotions may be time-limited, and orders/purchases may not qualify if they have not been fully processed by You within the stated time period. Promotions may not be combined with other promotions unless otherwise specifically stated. We reserve the right to amend or terminate a Promotion at any time without notice and without any liability to Us.
  2. We may from time to time at Our own discretion issue promotion codes ("Promotion Codes") as notified to You, which may be redeemed by you on the terms and conditions indicated in the Promotion Codes.
  3. If We think there is or has been misuse of a Promotion in any way, or the Promotion was offered (or We determine or believed used) in error, We reserve the right to withhold or cancel Your Promotion, deduct Credit or other features or benefits obtained through the use of the Promotion and/or suspend or even close Your Account without telling You.
Access To and Use of the Online Services
1. Access to the Online Services is free of charge and it is Your responsibility to make any and all arrangements necessary in order to access the Online Services. There is no guarantee that the Online Services will display correctly on all devices it can be viewed on.
2. Access to the Platform is provided "as is" and on an "as available" basis, and to the fullest extent permitted by law, We disclaim all warranties.
3. We may alter, suspend, or discontinue the Platform (or any part of it) at any time and without notice. We will not be liable to You in any way if the Platform (or any part of it) is unavailable at any time and for any period.
4. You acknowledge that there are certain jurisdictions within which it is unlawful to access the Online Services and/or Enter a Draw and You understand that it may be an offence for You to access the Online Services and/or Enter a Draw if You are prohibited or restricted from doing so under the laws of the jurisdiction in which You are located when transacting with Us. You warrant and undertake that You are not located in any such jurisdiction while transacting with Us. You are responsible for ensuring that it is legal for You to access the Online Services and/or Enter a Draw and You accept that it is Your responsibility to ensure compliance with applicable laws. You acknowledge that We do not take any responsibility nor are We liable for Your breach of any applicable law. In the event that We discover that You have Entered a Draw while located in a jurisdiction in which such Entry is unlawful, We will immediately terminate Your Account. Further, We will not be liable to pay a Prize to You in respect of any Entry which occurred whilst located in a jurisdiction in which such Entry is unlawful.
5. You warrant and undertake that You will only use Your Account, enter a Draw, partake in Promotions and/or Competitions or otherwise use the Online Services in accordance with these Terms, in a lawful matter and, in particular, without limitation:
  1. you will ensure that you comply fully with any and all local, national or international laws and/or regulations.
  2. You will not use the Platform in any way, or for any purpose, that is unlawful or fraudulent.
  3. You will not use the Platform to knowingly send, upload, or in any other way transmit data that contains any form of virus or other malware, or any other code designed to adversely affect computer hardware, software, or data of any kind.
  4. You will not use the Platform in any way, or for any purpose, that is intended to harm any person or persons in any way; and
  5. You will not authorize or allow anyone else to do the above.
6. You agree to indemnify and hold harmless Us against any and all claims, demands, proceedings, losses, expenses, damages, and costs, including legal costs, however arising, due to or arising out of, without limitation, Your wrongful or negligent use of Your Account, Topping Up Your Account with Credit, Entering a Draw, withdrawal of Prizes, partaking in Promotions and/or Competitions, redemption of Promotion Codes or breach by You of these Terms (including Rules).
7. Any and all Content included on the Platform and the copyright and other intellectual property rights subsisting in that Content, unless specifically labelled otherwise, belongs to or has been licensed by Us. All Content is protected by applicable intellectual property laws and treaties.
8. You may not reproduce, copy, distribute, sell, rent, sub-license, store, or in any other manner re-use Content from the Platform unless given express written permission to do so by Us. You agree, to the maximum extent permitted by law, not to reverse engineer or decompile (either in whole or in part) any software used in connection with the Platform and/or the provision of Millionaire.
9. Unauthorized attempts to upload information or change information contained on the Platform, including unauthorized alterations to the wording of any online forms available on the Platform strictly prohibited and will render the form or information invalid.
10. We shall not be liable for any delay, damage or loss and/or for the consequences of any delay, damage or loss, including but not limited to loss of opportunity, in case We are rendered wholly or partially unable to carry out Our obligations under this Agreement, if such delay is due to force majeure. For the purpose of this Agreement, force majeure means any circumstances or causes beyond the reasonable control and without the fault or negligence of Ours or any of Our associates, including but not limited to any strike, lock-out or other form of industrial action, acts of God, major outbreak of epidemics or other highly contagious illness, wars, civil unrest, riots, outbreak of hostilities, acts of terrorism, state of emergency, any government authority, semi government authority, including any relevant gaming authority action or inaction, any law or any action that stops Us from performing Our obligation under this Agreement. If at any time You decide that You do not agree with the Rules You should stop using the Platform and contact Us for more information or close Your Account. If You do continue to use the Platform, We are entitled to assume that You have accepted them.

Links to other external third-party sites may be included on the Online Services and other communications sent by Us. Unless expressly stated, these sites are not under Our control. We neither assume nor accept responsibility or liability for the content of third-party sites. The inclusion of a link to another site on the Online Services or other communication is for information only and does not imply any endorsement of the sites themselves or of those in control of them.
Viruses, Malware and Security
1. We exercise all reasonable skill and care to ensure that the Platform is secure and free from viruses and other malware. We accept no liability for any loss or damage resulting from a virus or other malware, a distributed denial of service attack, or other harmful material or event that may adversely affect Your hardware, software, data or other material that occurs as a result of Your use of the Platform, or any other site referred to on the Online Services.
2. You are responsible for protecting Your hardware, software, data and other material from viruses, malware, and other internet security risks.
3. You must not deliberately introduce viruses or other malware, or any other material which is malicious or technologically harmful either to or via the Platform. Nor should you attack, scan or deliberately reverse engineer the Platform by any means or attempt to gain unauthorized access to any part of the Platform, the environment on which the Platform is stored, the Central Computer System or any other server, computer, or database connected to or serving the Platform.
Disclaimers
1. Nothing on the Platform constitutes advice on which You should rely. It is provided for general information purposes only.
2. Insofar as is permitted by law, we make no representation, warranty, or guarantee that the Platform will meet Your requirements, that it will not infringe the rights of third parties, that it will be compatible with all software and hardware, or that it will be secure.
3. We make reasonable efforts to ensure that the Content on the Platform and communications is complete, accurate, and up to date. We do not, however, make any representations, warranties or guarantees (whether express or implied) that the Content is complete, accurate, or up to date and note there may be errors, omissions and typographical errors contained in the material provided. We make no commitment to update such information. Changes may be made periodically to laws, regulations, rules, and similar materials; these changes may or may not be incorporated in any new materials on the Platform, including the Terms. If You have obtained information on Millionaire from a source other than Us, be aware that data can be altered after its original distribution.
4. By using the Platform, you expressly agree that use is at Your sole risk. We do not warrant that the Platform will be uninterrupted or error free.
5. The Platform, any communication by or on behalf of Us, and the information contained therein, is directed only at persons who are eligible to create an Account and Enter a Draw. They are not meant to entice or encourage ineligible Participants to create an Account, Top Up their Account with Credit, purchase Products or Enter a Draw and are not an offer or invitation by the Manager to any person to do so.
6. You agree that neither We nor Our parent companies, subsidiaries, affiliates, partners, or licensors will be responsible or liable in contract, warranty or in tort (including negligence) for any (a) interruption to the Platform, the Grand Draw and the business (b) access delays or access interruptions to the Website, Platform or the Grand Draw or the Raffle Draw; (c) data non-delivery, missed delivery, corruption, destruction or other modification; (d) loss or damages of any sort incurred as a result of dealings with or the presence of off-website links on the Website, Platform; (e) computer viruses, system failures or malfunctions which may occur in connection with your use of the Website, Platform, including during hyperlink to or from third party websites (f) any inaccuracies or omissions in content or (g) events beyond our reasonable control.
Our Liability
1. Except to the extent that liability cannot be excluded by law, We will not be liable for any loss or damage, whether foreseeable or otherwise, You suffer as a result of Your use of or reliance on any information provided on the Platform, including, but not limited to, any loss or damage arising out of the registration of Your Account, the Top Up or attempted Top Up by You of Credit, the purchase or attempted purchase by You of Products, the Entry or attempted Entry by You, the use by You, the withdrawal or attempted withdrawal of Prizes or any inability to use the Platform, or the failure of the Platform to give effect to any offer by You to Top Up Your Account with Credit, purchase Products, Enter a Draw, partake in Promotions and/or Competitions or withdraw Prizes whether accepted by Us or not (even if you have previously advised us of the possibility of such loss).
2. In addition, We will not be liable to You for any loss or damage suffered by You arising from:
  1. events beyond Our reasonable control and expectations (for example situations arising from pandemic restrictions, war, fire, flood, drought, power cut and/or failure or obstruction of any network, broadcasting or telecommunications service).
  2. failure or destruction of, or damage to, all or part of the Central Computer System or Our records or any third party (including, without limitation, the Platform and/or Central Computer System).
  3. any mistakes caused by all or part of the Central Computer System or Our records or any third party (including, without limitation, the Platform, and/or Central Computer System).
  4. delays, losses, mistakes or omissions in or made by the banking and/or payment system.
  5. any other action or event which prevents or hinders the issue of a valid Entry (including without limitation the failure of the Platform to display correctly on any device used to view it).
  6. refusal to sell Top Up Credit and/or Products to any person or to allow any person to Enter a Draw, avail a Promotion or enter a Competition.
  7. any losses caused by You, including the misuse or unauthorized use of Passwords and the failure to keep Us informed of changes to Your personal contact details.
  8. any losses caused by the failure or malfunction of Your equipment or technology or Your internet service provider or mobile phone network operator, or the equipment, technology, internet service provider or mobile phone network operator of any other person or third party.
  9. any change in the design of the Grand Draw and/or the Raffle Draw or any Prize(s).
  10. any change in these terms and conditions.
3. Our only obligation is to pay the Prizes, in Iraq, won in a Draw to the rightful owners of eligible winning Entries.
4. You acknowledge and agree that in accepting these Terms You do not rely on, and shall have no remedy in respect of, any statement, representation, warranty (in each case whether negligently or innocently made) or understanding of any person whether or not that person is a party to these Terms. To the fullest extent permissible by law, We exclude all representations, warranties, and guarantees (whether express or implied).
5. Nothing in these Terms excludes or restricts Our liability for fraud or fraudulent misrepresentation, for death or personal injury resulting from negligence, or for any other forms of liability which cannot be excluded or restricted by law. Further, nothing in these Terms seeks to exclude or limit Your legal rights as a consumer.
General
1. The reasonable exercise by Us of any discretion provided for by these Terms will be final and binding.
2. If any provision (or part of a provision) in any of these Terms is decided by a court of competent jurisdiction to be void and/or unenforceable, that decision will only affect the particular provision (or part of the provision) and will not make the other provisions void or unenforceable.
3. You may not assign or otherwise transfer (in whole or in part) Your rights and/or obligations under these Terms. Any assignment or transfer by You will be null and void. We may assign or transfer Our rights and/or obligations under these Terms in whole or in part to any third party at Our sole discretion.
4. Except if We assign or transfer Our rights and/or obligations under these Terms, a person who is not a party to these Terms has no rights or otherwise to enforce any provision of these Terms.
5. We may amend these Terms (and the Additional Policies) from time to time. Such amendments, modifications or changes will be applicable and contractually binding with effect from the date of their publication on the Online Services and will apply after the date on which the changes become effective, and/or before that date if reasonable in the circumstances. You agree that it is Your own responsibility to keep yourself updated with such modifications and to check the Terms and Conditions and Additional Policies from time to time, and You agree that You will be bound by the changes when You next access Your Account, Top Up Your Account with Credit or Purchase a Product, Enter a Draw or Claim a Prize after the changes have become effective, or (where relevant) when You expressly accept the changes, whichever takes place first. If at any time You decide that You do not agree with the Terms You should stop using the Platform and contact Us for more information or close Your Account. If You do continue to use the Platform, We are entitled to assume that You have accepted them.
Governing Law and Jurisdiction
All disputes arising under these Terms and Conditions, including any Additional Policies (the "Policies") shall be exclusively governed by and interpreted in accordance with the laws in force in the Republic of Iraq, without regard to its conflict of laws principles. Any dispute arising out of or related in any manner to the execution, interpretation, or content of these Policies shall be finally exclusively resolved by arbitration in accordance with the rules of the Federation of the Chambers of Commerce Arbitration Centre ("FCCA"), Iraq. The seat of arbitration shall be Baghdad, in the Republic of Iraq, before a panel of three arbitrators. No party to these Terms will challenge the jurisdiction or venue provisions as provided in this provision.

ANNEX 1: Rules for Millionaire

These Rules for Millionaire (the "Rules") set out the various rules and procedures that apply when You Enter a Draw.

By Entering a Draw, you expressly agree to be bound by these Rules. We have also issued the Additional Policies and We recommend that You read and understand these before Entering. Copies of the Additional Policies can be found on the Online Services.

These Rules and the Additional Policies constitute the entire Agreement between You and Us in relation to You Entering a Draw. The Additional Policies are hereby incorporated into and form part of these Rules and by Entering a Draw, You agree to be legally bound by the Rules and Additional Policies.

Definitions and Interpretation

In these Rules, all capitalised words and expressions shall have the following meanings:

Term	Definition
Account	An online account maintained by a Participant on the Central Computer System which contains a Participant’s personal information and all other relevant details necessary to enable the Participant to Top Up Credit, purchase Products, enter a Draw, and withdraw Prizes.
Additional Policies	The Privacy Policy, the Cookies Policy, Social Media Guidelines, FAQs, and any other policy that may be added from time to time.
IQD	Iraqi Dinar, the lawful currency of the Republic of Iraq.
App	The Millionaire mobile application which is distributed through the Apple App Store and Google Play Store.
Authorised Financial Institution	Any banking organization or financial institution authorized by the Manager to pay certain Prizes.
Ball Sets	A set of forty (40) 50mm (8.5-9.0g) balls made of rubber & foam composite materials and numbered from one ( 1 ) to forty (40).
Central Computer System	The computer systems used by the Manager from time to time, among others, manage Millionaire, administer Accounts, facilitate the Topping Up of Credit, purchase Products, enable Entry into a Draw, generate Raffle IDs, and pay Prizes.
Cookies Policy	The Millionaire Cookies Policy, a copy of which can be located on the Online Services.
Credit	Credit is Topped Up via a debit or pre-paid card, Ewallet, cash, through Winnings or Competition and/or Promotional Prizes and, where applicable, is located in the "Available Balance" section of Your Account. Credit is used (and can only be used) to purchase Products.
Available Balance	A section in each Participant’s Account which shows Credit.
Customer Support	Millionaire customer support, which can be contacted toll-free from within Iraq on 800 40000 from 09:00 am to 10:00 pm (Iraq time), 6 days a week from Saturday to Thursday or by emailing support@millionaire.iq.
Draw	The Draw held on Saturdays, and the process which results in the random selection of the Grand Draw and Raffle Winning Numbers.
Draw Machine	A machine that mechanically mixes the Ball Sets and randomly selects the Winning Numbers from that mix for any Draw.
Draw Manager	An employee of the Manager whose responsibility it is to organize and manage each Draw.
Draw Process Contingency Plans	A process that is aimed at addressing any potential risks that may occur during the pre-Draw Procedure or during the live Draw process and providing for proper backup plans that will reduce any possible disruptions to the Draw process.
Draw Procedures	The internal procedures that apply to a Draw, as determined by the Manager from time to time.
Entry	A transaction by which a Participant’s entry into a Draw has been recorded as an Entry on the Central Computer System. Enter, Enters, Entered, and Entering shall have correlative meanings.
Favourites	A facility whereby a Participant may save their favourite numbers for entering a Grand Draw.
Grand Draw	The process which results in the random selection of the Grand Draw Winning Numbers using a Grand Draw Machine.
Grand Draw Winning Numbers	The four ( 4 ) numbers between one ( 1 ) and forty (40) (inclusive) that have been randomly selected for each Grand Draw by the Grand Draw Machine and which are used to determine the Prizes for the Grand Draw.
CMC Representative	A representative from the Republic of Iraq Communications and Media Commission (CMC), who moderates the Draw to confirm its integrity and fairness.
Immediate Family Members	With respect to any individual, such individual’s partner (including, without limitation, spouse, and qualified domestic partner) and persons who are, to some extent, maintained by anyone mentioned in Rule 2.2(d)(i) to (iii), in either case if living in the same household as that person.
Grid	A number panel through which 4 numbers are selected from a total of 40 numbers (from 1 to 40) - (either manually, using preferred numbers, or through the quick/random selection feature) to enter the grand draw.
Set	The four ( 4 ) numbers between one ( 1 ) and fourty (40) (inclusive) that have been chosen by You (whether manually, by Favourites or Quick Pick) for entry into a Grand Draw.
Millionaire	A Raffle and Grand Draw managed in Iraq, the result of which is determined by a Draw.
Match Four	Correctly matching four ( 4 ) numbers with all four ( 4 ) Grand Draw Winning Numbers.
Match Three	Correctly matching three ( 3 ) numbers with three ( 3 ) of the Grand Draw Winning Numbers.
Match Two	Correctly matching two ( 2 ) numbers with two ( 2 ) of the Grand Draw Winning Numbers.
Match One	Correctly matching one ( 1 ) number with one of the Grand Draw Winning Numbers.
Manager, We or Us	Bahidh Al Khair, a limited liability company incorporated in Baghdad acting in its role as the appointed operator of Millionaire.
Online Services	The App and Website.
Participant, You or Your	A member of the public who intends to or Top Up Credit, purchases Products and/or Enters a Draw.
Password	The alphanumeric and special character identifier used by a Participant to identify themselves when accessing their Account. The password policy is: customer can select any 8 characters, numbers, or special characters and all are case sensitive.
Privacy Policy	The Millionaire Privacy Policy, a copy of which can be located on the Online Services.
Prize	A cash prize won by an eligible Participant in a Raffle Draw and/or one of the Match One to Match Four Prize categories in a Grand Draw, as determined in accordance with these Rules.
Product	A product (in whatever form) available to purchase via the Online Services and Kiosks using only Credit. Every Product purchased will be donated and channeled through our community partners to the needy. You will be eligible to submit one ( 1 ) Set (and subsequently will receive one ( 1 ) Raffle ID) for every Product purchased.
Quick Pick	A feature whereby a set of four ( 4 ) numbers for the Draw are selected for a Participant on a random basis by the Central Computer System.
Raffle Draw	The process which results in the random selection of the Winning Raffle IDs using a Random Number Generator.
Raffle ID	A unique identification number that is automatically generated by the Central Computer System and assigned to each Set and which constitutes one ( 1 ) entry into the Raffle Draw.
Random Number Generator	A computer software system using a random number generator that randomly selects the Winning Raffle IDs from all Raffle IDs entered for the relevant Raffle Draw.
Rules	These Rules for Millionaire.
Syndicate	A group of players who Top Up Credit, purchase a Product and Enter a Draw together and share any Prize in proportion to the contribution of each group member.
Syndicate Member	A member of a Syndicate.
Terms	The Millionaire general terms and conditions, a copy of which can be located on the Online Services.
Iraq	The Republic of Iraq.
Website	Millionaire’s web address is www.millionaire.iq (or such other address as may be advised from time to time).
Winning Numbers	The Winning Raffle IDs and the Grand Draw Winning Numbers for the relevant Draw.
Winning Raffle IDs	The Raffle IDs that have been randomly selected for each Raffle Draw by the Random Number Generator and which are used to determine the Prizes for that Raffle Draw.

Unless the context otherwise requires, words in the singular shall include the plural and, in the plural, shall include the singular.
Any words following the terms "including", "include", "in particular", "for example" or any similar expression shall be construed as illustrative and shall not limit the sense of the words, description, definition, phrase or term preceding those terms.
In the event of any conflict or inconsistency between the various documents set out above, the order of precedence is: ( 1 ) the Terms; ( 2 ) these Rules; ( 3 ) the Privacy Policy; and ( 4 ) the Cookies Policy.
In the event of any conflict or inconsistency between the English and Arabic translations of these Rules, the English version of these Rules shall prevail to the extent of the inconsistency.
If there is any inconsistency between the instructions on the Online Services and Retail Stores, point of sale materials and/or advice and these Rules, these Rules prevail to the extent of the inconsistency.

Entering a Draw
1. Products are available for purchase from the Online Services and retail stores at a cost of IQD 3,000 (three thousand dinars) of Credit (or such other amount as We may, from time to time, determine) per Product. You will be able to collect your product from designated locations which are featured in the website. Failure to collect within one Calander month will result in the collection right being forfeited by the Company.
2. Each Product purchased will provide You with one ( 1 ) complimentary Entry to the Draw (which consists of one ( 1 ) Entry into the Raffle Draw and one ( 1 ) Entry into the Grand Draw).
3. You may only Enter if You:
  1. are at least 18 years of age.
  2. are not prohibited or restricted from Entering under the laws of Your jurisdiction of residence or jurisdiction in which You are located when Entering;
  3. at all times abide by these Rules and the Terms.
  4. Have an active Iraqi mobile number
  5. are not:
    1. a shareholder, manager, or employee of the Manager.
    2. the Republic of Iraq Communications and Media Commission Representative, or the Draw Manager;
    3. a third party, contractor or consultant of the Manager engaged to review the insurance, audit and security procedures related to the Draw.
    4. an Immediate Family Member of those mentioned in Rules 2.3(d)(i) to 2.3(d)(iii);
    5. on a global list of high-risk and sanctioned individuals.
4. To Enter the Draw, You will be required to purchase a bottle of water. You can do this by choosing four ( 4 ) numbers in one Grid , either manually, by Quick Pick Favourites in accordance with the instructions on the Online Services. Once You have confirmed the numbers in your Grid, You will be Entered into the relevant Draw, and You will not be able to cancel Your Entry.
5. With each bottle of water purchased and Entered into a Draw, You will also receive a Raffle ID. Your Raffle ID will automatically be Entered into the Raffle Draw taking place on the corresponding date of the Draw. Your Raffle ID will be located on Your ticket in the "Purchase History" section of Your Account.
6. Products can only be purchased using Credit - please follow the instructions provided on the Online Services. For every Product purchased, You will receive one ( 1 ) complimentary Entry into the Draw (which consists of one ( 1 ) Entry into the Raffle Draw and one ( 1 ) Entry into the Grand Draw). Where a request to purchase a Product is accepted by Us, the corresponding amount of Credit will be deducted from Your Available Balance. If You have any questions, please contact Customer Support.
7. If you do not receive an acknowledgement of Your Entry, Your Entry may not have been recorded on the Central Computer System and therefore it may not be valid. In the event You do not receive an acknowledgement, please check Your Account to see if Your Entry has been registered. If You cannot see it, please contact Customer Support.
8. Entries made on the day of the relevant Draw after 19:25 hours (Iraq Standard Time), or such other time or day as We may determine, will not be entered into that Draw.
9. There is no general right for a Participant to Enter a Draw. We may refuse Entries and/or limit the number of Entries You can make without giving a reason.
Draw
1. We will determine the game design, the Prize structure, time, frequency, date, and method of both the Raffle Draw and the Grand Draw for Millionaire, which We may change from time to time at our sole discretion (including but not limited to any of the Grand Draw Prize(s) and/or the Raffle Prize(s). You are fully and solely responsible for regularly verifying the Millionaire website for any changes to the Grand Draw and/or the Raffle including without limitation to the Prize(s) as and when these changes are announced by Us. As at the date of these Rules, the Raffle Draw and the Grand Draw will be held during the Millionaire live show which is aired on the Website and the Millionaire YouTube and Facebook pages at approximately 19:30 hours (Iraq Standard Time) on each Saturday. The day and time of the Millionaire may be changed from time to time.
2. The Raffle Draw will be made using the Random Number Generator or such other audited equipment/method as We may from time to time in Our sole discretion determine. All Raffle IDs Entered for the relevant Raffle Draw will be uploaded into the Random Number Generator, which will select Raffle IDs at random; these Raffle IDs will constitute the Winning Raffle IDs for the relevant Raffle Draw.
3. Each Grand Draw will be made using the Grand Draw Machine or such other audited equipment/method as We may from time to time in Our sole discretion determine.
4. All Draws will be conducted in accordance with the Draw Procedures and in the presence of the Draw Manager, and/or Republic of Iraq Communications and Media Commission Representative.
5. In the event that a Draw does not take place, it shall either be cancelled at Our Own discretion or moved to a later time as notified by Us. If a Draw is invalid or interrupted due to equipment failure or for any other reason, the Draw will be completed in accordance with the Draw Procedures.
6. In the event that during any Draw, a mechanical failure or operator/human error causes an interruption in the selection of all digits, the failed Grand Draw Machine will be replaced with a reserve machine and the Draw shall resume. Any digit drawn prior to the mechanical failure shall stand valid and be declared official.
Results
1. The Winning Numbers for each Draw will be made available on the Online Services and through Customer Support as soon as practicable after each Draw. The Winning Numbers will also be issued to the national media and may be published in such other manner as We may from time to time determine. You will have no claim for compensation for any failure on Our part to publicise the Winning Numbers or for failure to notify holders of winning Entries; it is solely Your responsibility to check Your Entries against the Winning Numbers.
2. You will not be entitled to claim for compensation, and We will not be bound by any errors contained in any announcement or publication, whether typographical, printing or otherwise or any publication or announcement of the amount of the Prizes in a Draw (including, without limitation, where the announcement or publication is made before the amount to be paid in Prizes is finalised).
3. In the event of a discrepancy between the Winning Numbers published on the Online Services and/or other announcement or publication and the official Winning Numbers contained on the Central Computer System, the latter shall prevail.
4. In the event that the final verified number of winning Entries is different than the initial publicised number of provisional winning Entries, the Prize money payable to such winners may vary.

2. There will be a minimum of Two Hundred Fifty Four (254) Winning Raffle IDs for each Raffle Draw.
  1. Participants whose Tier 1 Raffle IDs match those of the Winning Raffle IDs will each win IQD 1,000,000 (One million Iraqi dinars) or such other amount as may be determined and announced by Us in Our sole discretion.
  2. Participants whose Tier 2 Raffle IDs match those of the Winning Raffle IDs will each win IQD 100,000 (One hundred thousand Iraqi dinars) or such other amount as may be determined and announced by Us in Our sole discretion.
  3. Participants whose Tier 3 Raffle IDs match those of the Winning Raffle IDs will each win IQD 25,000 (twenty five thousand Iraqi dinars) or such other amount as may be determined and announced by Us in Our sole discretion.
  4. Participants whose Tier 4 Raffle IDs match those of the Winning Raffle IDs will each win IQD 10,000 (ten thousand Iraqi dinars) or such other amount as may be determined and announced by Us in Our sole discretion.
  5. If You reside outside of Iraq, You will be asked to be present in Iraq to claim the Raffle Prize.
  6. You may be required to attend public relations and media activities as notified by Us.

There are four ( 4 ) Prize categories in each Grand Draw:
1. Match One – the Participant has correctly matched one ( 1 ) number with the Grand Draw Winning Numbers;
2. Match Two – the Participant has correctly matched two ( 2 ) numbers with the Grand Draw Winning Numbers
3. Match Three - the Participant has correctly matched three ( 3 ) numbers with the Grand Draw Winning Numbers;
4. Match Four - the Participant has correctly matched four ( 4 ) numbers with the Grand Draw Winning Numbers; and
The Match Four Prize is fixed at a minimum top prize of IQD 20,000,000 (Twenty Million Iraqi Dinars Only) to be shared with other winners who matched four out of four numbers in the Grand Draw.
The Match Three Prize is fixed to a minimum top prize of IQD 200,000 per Winner per Grand Draw. The Match Three Prize will be awarded per winner.
The Match Two winner(s) will win IQD 5,000 (Five Thousand Iraqi Dinars Only) per winner per Grand Draw.
The Match One winner(s) will receive IQD 1,000 (One Thousand Iraqi Dinars Only) per Grand Draw.
Participants that match numbers from the Grand Draw Winning Numbers drawn will only win in one Prize category per single Set but shall be entitled to receive the Prize for the highest Prize category won (i.e., if You are a Match Four winner, you will only receive the Match Four Prize – You will not receive a Match Three, Match Two and Match One Prize).

General
1. All Prize winners will be notified by WhatsApp and via phone call, in-Account messages, and, where relevant, push notifications. You remain responsible for claiming Your Prize.
2. Federal and jurisdictional income taxes may apply to any monetary Prize and are the sole responsibility of the Participant.
3. Prize winning and all aspects of Millionaire are subject to these Rules and the Additional Policies.

Payment of Prizes
1. Prior to the payment of a Prize, which must be claimed within Iraq, the Entry must be validated according to Our validation procedures, including potentially screening Participants against a global list of high-risk and sanctioned individuals. Any paper receipt or confirmation of an Entry provided by retail stores is not and will not be accepted as valid proof of Your right to a Prize. Our decision as to the validity of an Entry is final and binding.
2. In addition, prior to a Prize being paid, You may be required to provide:
  1. full and complete valid identification documentation; and/or
  2. a statutory declaration as to ownership, entitlement, and compliance with relevant laws.
3. We will only pay a Prize based on the official Winning Numbers of the relevant Draw recorded in line with Rule 3.5 and will not pay a Prize based on results recorded elsewhere.
4. Subject to verification of identity, proof of age and Entry validation, all Prizes will be directly credited to Your Available Balance in Your Account after the relevant Draw.
5. In order to withdraw Your Prize, You will need to raise a withdrawal request using one of the available payment channels as referred to in the Website.
6. Payment of the Prize to the "Available Balance" of the winning Account holder shall fully and effectively discharge Us, Our officers, employees, representatives, contractors, any person or firm authorised by Us to pay Prizes, from any further liability for payment of that Prize.
7. Without limiting the effect of Rule 6.1, We reserve the right to:
  1. withhold a Prize until We are satisfied that an Entry is valid and/or the Account holder is lawfully entitled to payment of a Prize;
  2. request proof of entitlement to a Prize (including, without limitation, identification information, proof of identity, residency, or location when Entering a Draw and capacity to claim);
  3. invite a court to decide who a Prize should be paid to and/or make payment into court;
8. We reserve the right to refuse and will not be liable to pay a Participant a Prize if:
  1. the Participant does not meet the eligibility criteria in Rule 2.3;
  2. We reasonably believe You are involved in any activity which in Our discretion is illegal, inappropriate, or unacceptable, including but not limited to fraud, money laundering, collusion or cheating of any kind; or
  3. You are unable or fail to supply the necessary identification documentation when withdrawing a Prize.
    If a Prize is paid to anyone who does not meet such eligibility criteria, that person will be obliged to repay the Prize immediately upon Our request. We reserve the right to recover any incorrectly paid Prize.
9. We will not be responsible or liable to any person claiming a Prize which has been paid to a person who assumed the identity of the relevant Account holder.
10. Under no circumstance will interest be payable on any Prize.
11. Prizes will be paid in full only to the registered holder of the Account with the winning Entry, unless You are a person with a legal, physical, or other disability and are claiming a Prize, where, in these circumstances, We may, at our sole discretion, pay the Prize to Your authorised representative.
12. In the event of the death of an Account holder, a person can withdraw a Prize on behalf of such deceased’s estate where they can prove, to Our satisfaction, that they are entitled to make such a withdrawal (for example, by providing a grant of probate).
13. All Prizes will be paid in Iraqi Dinar the amount advised by Us as the final amount payable for that winning Entry. Due to anti-money laundering rules and regulations in Iraq, any Prize above IQD 10,000,000 will only be paid through an exchange house.
14. We disclaim any and all liability, including any express or implied warranties, whether oral or written, to any Syndicate Members. By Entering a Draw, You acknowledge that no representation has been made by Us that We shall be responsible for or have any liability whatsoever for any purported claim from a Syndicate Member. For the avoidance of doubt, We will only be liable for any valid claim made by the registered holder of the Account with the winning Entry.
Winners' Information
1. By Entering the Draw, You authorise Us to disclose and publish Your personal data (including name, city of residence, nationality, photos, and the amount of the Prize won) publicly and on any media platforms (including, for the avoidance of doubt, the Online Services and Our social media platforms) as is deemed appropriate at Our sole discretion This information can be disclosed to any person(s) and in any mode or manner as We may deem appropriate. You agree to participate in any publicity surrounding Your win, as reasonably required by Us (including without limitation interviews of all kinds, filming (e.g., show attendance), appearances on all media channels, other related media activities (i.e., print, TV and radio etc). In addition, as a top tier prize winner you will be requested to agree and sign Our Publicity Waiver Release.
2. We can, in exceptional circumstances, keep Your identity private, but only if You can demonstrate, to Our satisfaction and at Our sole discretion, a high risk of harm should this information be made public.
3. Notwithstanding Rule 7.2 above, You understand and accept that, regardless of any requested anonymity, We may, if required by law, provide a third party with Your details and the details of any Prize claimed by You or on Your behalf, or paid to You.
Draw Postponement
If We deem it reasonable to do so, We may delay a Draw for as long as We believe it to be appropriate in the circumstances. In these instances, both the Grand Draw and the Raffle Draw will be postponed, and Participants will be permitted to Enter the delayed Draw beyond the normal cut-off times.
Draw Closure
We can, at Our absolute discretion, announce the closure, withdrawal, or suspension of the Raffle Draw and/or Grand Draw at any time. No Entries for the Raffle Draw and/or Grand Draw will be permitted after such time.
Limitation of Liability
1. Our only obligation is to pay the Prizes won in any Draw to the rightful owners of winning Entries. We will not be liable in any circumstances for any loss of whatever nature other than, subject to Rule 10.2, the non-payment of a Prize to the rightful owners of winning Entries.
2. We shall not in any circumstances be liable for any loss, direct or consequential, or damage incurred by any Participant or any other person arising from the participation by any person in Millionaire. In particular, but without prejudice to the generality of this rule, We shall not be liable to any person for:
  1. events beyond Our reasonable control and expectations (for example, without limitation, war, strike, lockout, industrial action, fire, flood, drought, power cut and/or failure or obstruction of any network, broadcasting or telecommunications service);
  2. the failure or destruction of, or damage to, all or part of the Central Computer System or Our records or any third party;
  3. any mistakes caused by all or part of the Central Computer System or Our records or any third party;
  4. delays, losses, mistakes, or omissions in or made by the banking system (including for the avoidance of doubt, any secure payment provider);
  5. any other action or event which prevents or hinders the issue of a valid Entry (including without limitation the failure of the Online Services to display correctly on any device used to view it).
3. Nothing in these Rules excludes or limits (a) any person’s liability (i) for fraud; or (ii) for death or personal injury caused by breach of any duty that person may have to take reasonable care or exercise reasonable skill; or (b) any other liability which cannot lawfully be excluded or limited.
General
1. The reasonable exercise by Us of any discretion provided for by these Rules, including with respect of the determination of a winning Entry or payment of a Prize will be final and binding unless otherwise provided by law.
2. In the event that a dispute arises, we may withhold payment of a Prize and/or make an equivalent payment into court until it has been resolved.
3. If any provision (or part of a provision) in any of these Rules is decided by a court of competent jurisdiction to be void and/or unenforceable, that decision will only affect the particular provision (or part of the provision) and will not, in itself, make the other provisions void or unenforceable.
4. You may not assign or otherwise transfer (in whole or in part) Your rights and/or obligations under these Rules, including, for the avoidance of doubt, the right to a Prize. Any assignment or transfer by You will be null and void. We may assign or transfer Our rights and/or obligations under these Rules in whole or in part to any third party at Our sole discretion.
5. Except if We assign or transfer Our rights and/or obligations under these Rules, a person who is not a party to these Rules has no rights or otherwise to enforce any provision of these Rules.
6. We may amend these Rules (and the Additional Policies) from time to time. Such amendments, modifications or changes will be applicable and contractually binding with effect from the date of their publication on the Online Services and will apply to Entries made after the date on which the changes become effective, and/or Entries made before that date. You agree that it is Your own responsibility to keep yourself updated with such modifications and to check the Rules and Additional Policies from time to time and that You will be bound by the changes when You next access Your Account, Top Up Your Account with Credit or Purchase a Product, Enter a Draw or claim a Prize after the changes have become effective, or (where relevant) when You expressly accept the changes, whichever takes place first. If at any time You decide that You do not agree with the Rules You should stop using the Platform and contact Us for more information or close Your Account. If You do continue to use the Platform, We are entitled to assume that You have accepted them.
